Also what about the people that buy tickets from other people or online and then resell them online for profit? Do they need to have a ticket broker license? Should I be asking people if they have a ticket broker license before I buy tickets off of them?
I would prefer an answer with some justification, other than just someone's opinion on their observations or thoughts. Like a website with rules and regulations b/c apparently some people that answered this question originally are living in 2005 and believe scalping is illegal still.
It actually depends on the city and state. Some cities have broker zones that allow other strictly prohibit it in any form. As far as sources go, the back pages of the book called "The Poor Man's Guide to Buying Scalper Tickets" has an appendix in the back with state by state details. Or you could just email the author, Fred Salas, I've found him to be very responsive.

I am trying to get tix to Cleveland Indians game but am from Detroit area. The game is July 29 in Cleveland, against Detroit. I cant seem to find a broker site, or any site (including ticketmaster) that doesn't charge outrageous fees. Is there any site that just charges tickets prices, and maybe a shipping charge only? Issued this afternoon was an official statement from the National Association of Ticket Brokers, which bills itself as “the non-profit trade association dedicated to protecting consumers and the secondary ticket market,” responding to Steve Wynn’s aggressive efforts to prevent the scalping of tickets to Garth Brooks’ shows at Encore Theater.
In the statement, issued via e-mail, NATB General Counsel Gary Adler, says:
“As a top travel destination, Las Vegas is one of the largest markets for secondary ticket sales. The average visitor can’t always plan their trips around the most popular shows, or track down the best seats as soon as they go on sale.
“Fans hire brokers to help them find the tickets they want, for the price they can pay, or to resell the tickets they can’t use. Wynn has no right to tell these fans ‘hey, tough luck - unless you bought them at our box office within two hours of going on sale then you can’t go to the show.’
