Is there any action that we can take towards the mortgage broker? We have been in contract for a little over 2 months. The buyers are getting an FHA and had a few late payments about 2 years ago that affected their credit. Their realtor said that they got this fixed mid-may. Their lawyer sent our lawyer a letter on May 29 (when our contract expired) that was dated for May 6 asking for a 2 week extension. In the letter the lawyer also explained that they had everything that they needed and were still awaiting the committment letter. Now the mortgage broker promised my lawyer that on June 2 they would have the letter. The mortgage broker did not return my lawyers phone calls for two days and now their realtor says that they are waiting to have their credit fixed. The broker has lead us all to beleive that they are getting the committment any day now. If the mortgage broker would have told us the truth from the start my husband and I would still be working and would be waiting patiently. We do not deserve this. We are only asking for the truth so we can actually plan out cross-country move.
You are out of contract, so if you were my cleint, I would advise that you let this buyer go. Does not sound as though they are going to have their credit rating in order any time soon. "A few late payments 2 years ago" - if everything else is fine - should not cause disqualifying credit ratings, there is more at play here.
I suspect it was a bunch of late payments that caused a foreclosure, but I am skeptical like that sometimes.
You can take action, and I would start with this mortgage broker's supervisor. If you are suggesting legal action, you can take any action you want, but whether you can successfully prevail is another issue.
